Abstract:
Many theorists take the view that literal meaning can be one of a number of factors to be weighed in reaching a legal interpretation. Still others regard literal meaning as having the potential to legally justify a particular outcome. Building on the scholarly response to HLA Hart’s famous ‘vehicles in the park’ hypothetical, this article presents a formal argument that literal meaning cannot be decisive of what’s legally correct, one which, unusually, makes no appeal to controversial theories within philosophy of language or literary criticism. If the argument is sound, it follows that an enactment’s literal meaning neither weighs in the determination of correct legal outcomes nor permits the application of a sequencing model, ie a non-monotonic logic, to its interpretation. These implications are considerably more controversial within contemporary legal theory than the idea that a statute’s literal meaning is not necessarily its legal meaning. Abstract:
Few nineteenth-century formulations of Ireland's suffering under British rule were as explicit as those of Karl Marx and Friedrich Engels in focusing away from essentialist explanations cast in the language of British villainy, and in concentrating instead on material factors, on the conjoined expansion of capitalism in Britain and underdevelopment in Ireland. This is plainly evident even in the very manner in which Ireland features in the chapter organisation of their explicitly theoretical work. Ellen Hazelkorn points out that, by placing consideration of Irish agriculture in the chapter headed the 'General Law of Capitalist Accumulation', Marx scorned the historicist argument that focused attention on the Act of Union and English anti- Irishness, and turned to evaluate how the transference of capital, foodstuffs, and labour from Ireland to England formed an integral and necessary part of their respective economic growth (Hazelkorn 198 I: 26). Abstract:
We present the results of a search for pulsed TeV emission from the Crab pulsar using the Whipple Observatory's 10 m gamma-ray telescope. The direction of the Crab pulsar was observed for a total of 73.4 hours between 1994 November and 1997 March. During this period the Whipple 10 m telescope was operated at its lowest energy threshold to date. Spectral analysis techniques were applied to search for the presence of a gamma-ray signal from the Crab pulsar over the energy band 250 GeV to 4 TeV. We do not see any evidence of the 33 ms pulsations present in other energy bands from the Crab pulsar. The 99.9% confidence level upper limit for pulsed emission above 250 GeV is derived to be 4.8x10^-12 cm^-2 s^-1 or <3% of the steady flux from the Crab Nebula. These results imply a sharp cut-off of the power-law spectrum seen by the EGRET instrument on the Compton Gamma-Ray Observatory. If the cut-off is exponential, it must begin at 60 GeV or lower to accommodate these upper limits.

Abstract:
The detection of spectral variability of the gamma-ray blazar Mrk 421 at TeV energies is reported. Observations with the Whipple Observatory 10m gamma-ray telescope taken in 2000/2001 revealed exceptionally strong and long-lasting flaring activity. Flaring levels of 0.4 to 13 times that of the Crab Nebula flux provided sufficient statistics for a detailed study of the energy spectrum between 380 GeV and 8.2 TeV as a function of flux level. These spectra are well described by a power law with an exponential cutoff. There is no evidence for variation in the cutoff energy with flux, and all spectra are consistent with an average value for the cutoff energy of 4.3 TeV. The spectral index varies between 1.89 in a high flux state and 2.72 in a low state. The correlation between spectral index and flux is tight when averaging over the total 2000/2001 data set. Abstract:
The BL Lacertae (BL Lac) object 1ES 2344+514 (1ES 2344), at a redshift of 0.044, was discovered as a source of very high energy (VHE) gamma rays by the Whipple Collaboration in 1995 \citep{2344Catanese98}. This detection was recently confirmed by the HEGRA Collaboration \citep{2344Hegra03}. As is typical for high-frequency peaked blazars, the VHE gamma-ray emission is highly variable. On the night of 20 December, 1995, a gamma-ray flare of 5.3-sigma significance was detected, the brightest outburst from this object to-date. The emission region is compatible with a point source. The spectrum between 0.8 TeV and 12.6 TeV can be described by a power law $\frac{\ud^3 N}{\ud E \ud A \ud t}=(5.1\pm1.0_{st}\pm1.2_{sy})\times10^{-7} (E/ \mathrm{TeV})^{-2.54 \pm0.17_{st}\pm0.07_{sy}} \mathrm{\frac{1}{TeV m^2 s}}$. Abstract:
Multiwavelength observations of the high-frequency-peaked blazar 1ES2344+514 were performed from 2007 October to 2008 January. The campaign represents the first contemporaneous data on the object at very high energy (VHE, E >100 GeV) {\gamma}-ray, X-ray, and UV energies. Observations with VERITAS in VHE {\gamma}-rays yield a strong detection of 20 {\sigma} with 633 excess events in a total exposure of 18.1 hours live-time. A strong VHE {\gamma}-ray flare on 2007 December 7 is measured at F(>300 GeV) = (6.76 \pm 0.62) \times 10-11 ph cm-2 s-1, corresponding to 48% of the Crab Nebula flux. Excluding this flaring episode, nightly variability at lower fluxes is observed with a time-averaged mean of F(>300 GeV) = (1.06 \pm 0.09) \times 10-11 ph cm-2 s-1 (7.6% of the Crab Nebula flux). Abstract:
Interpreting the cosmological constant as a pressure, whose thermodynamically conjugate variable is a volume, modifies the first law of black hole thermodynamics. Properties of the resulting thermodynamic volume are investigated: the compressibility and the speed of sound of the black hole are derived in the case of non-positive cosmological constant. The adiabatic compressibility vanishes for a non-rotating black hole and is maximal in the extremal case — comparable with, but still less than, that of a cold neutron star. A speed of sound vs is associated with the adiabatic compressibility, which is is equal to c for a non-rotating black hole and decreases as the angular momentum is increased. An extremal black hole has v2 s = 0.9 c2 when the cosmological constant vanishes, and more generally vs is bounded below by c/√2.

Abstract:
The new conventional wisdom is that network utilities should be unbundled, with the potentially competitive segments under separate ownership from the natural monopoly network. Regulation should provide the same incentives as the competitive market, differing sharply from the traditional rate-of-return form evolved in the United States. But the new model has problems. Unbundling creates new price risks that require hedging. The consequences of the risks and resulting hedging contracts are often not well understood by regulators. The conditions for effective competition, at least in electricity, are considerably more demanding than in normal product markets. Competition law may need to be adapted to be effective.

Abstract:
Software maintenance continues to be a time and resource intensive activity. Any efforts that help to address the maintenance bottleneck within the software lifecycle are welcome. One area where such e orts are useful is in the identification of the parts of the source-code of a software system that are most likely to contain faults and thus require changes. We have carried out an empirical study where we have merged information from the CVS repository and the Bugzilla database for an open-source software project to investigate whether or not parts of the source-code are faulty, the number and severity of faults and the number and types of changes associated with parts of the system. We present an analysis of this information, showing that Pareto's Law holds and we evaluate the usefulness of the Chidamber and Kemerer metrics for identifying the fault-prone classes in the system analysed.

<p>Best Newcomer Article</p> <p>The design of policy tools reveals underlying biases that are not easily identified in policy documents. A review of two early childhood education and care subsidies in Ireland aimed at different target populations exposes differential treatment of children, parents and service providers. It also demonstrates how in a split system ‘early education’ is prioritised over ‘childcare’. The designs serve to reinforce stereotypes that enable the powerful and advantaged to accrue benefits while those perceived to be less deserving are burdened through the maldistribution of resources.</p>
